Now the question remains, what is going to roll out first? The consumers will notice these changes being implemented after the retailer settled a $65,000 class-action lawsuit.

Details about the changes

The home improvement retailer, Home Depot, was accused of violating a law which were meant to help consumers with disabilities. The retailer settled a class-action lawsuit after plaintiffs alleged that the retailer did not provide private, safe, independent, and equal access to those who are blind, as reported by Claim Depot.

In addition, it has been found that class action members accused the defendant of violating the Americans with Disabilities Act. The Americans with Disabilities Act was signed into law in 1990. This specific act prohibits discrimination against individuals who has any form of disability when it comes to employment, state and local government services, public accommodations, and transportation. Under this specific act, those with disabilities should have “readily achievable” access to services.

It is important to note that for something to be “readily achievable,” it should be easily accomplished and able to be carried out without much difficulty or expense. It has been stated that class members alleged that the retailer did not provide proper accommodations for those with disabilities at the checkout terminals. Those consumers who are might have been visually impaired require audio readouts of on-screen prompts and tactile keypads.

The retailer does not adhere to the requirements

Many consumers have been stating that the retailer does not adhere to the aforementioned requirements. For this reason, it is placing those consumers with disabilities at a disadvantage. Members of the retailer has made claims that allegedly Home Depot does not adequately meet those requirements.

The consumers claim that the retailer denied these members “full and equal enjoyment of Home Depot’s payment terminals’ cash-back feature at any Home Depot store in the United States.” This cash-back feature is clearly not suitable for all to enjoy which means that the company is allowing some consumers to be left out. This is where the retailer might not have adhered to what is stated in the Americans with Disabilities Act.

In addition, the lawsuit alleges explicitly that the retailer’s terminals did not provide audio output for cash-back options. Also, the terminals did not make provision for any audio output to announce the totals or the amount of cash dispensed, as outlined by the lawsuit.

As a result of this, the lack of audio tools meant that individuals who may have visual impairments could not use the machine without assistance from others. It is important to note that Home Depot has denied any liability in this case.

Checkout changes at Home Depot

Although the retailer has not accepted accountability, the hardware retailer agreed to settle the lawsuit for $65,000. For this reason, class action members will not receive any payout from the settlement. Since there will be no payment, the class members do not have to file a claim in order to receive the benefits from the settlement. So, instead of going to payout route, the retailer will be required to make the necessary accessible improvements to the company’s checkout terminals.

In addition, the store will also be required to provide specific training opportunities to managers on this new terminal software that will be implemented. Home Depot did not immediately make any comments or respond to The U.S. Sun’s request for comment. Software will be implemented that will be useable by all consumers including those who may have a disability.

The American home improvement retailer, The Home Depot, is busy implementing changes to its checkout process. Home Depot made a decision to agree to train managers and update terminals.
