Today is the final day affected consumers can still manage to receive up to $53, 000. The customers of one of America’s retail giants, Walmart, should immediately take action if they want to get something out of a data breach lawsuit. Customers are encouraged to respond as soon as possible because time is limited, and action need to occur since sensitive information were breached. After today, there will not be another opportunity for customers to submit their claim, therefore, they are encouraged to do so NOW.

Data Breach at Walmart

This data breach at the retailer powerhouse, Walmart, occurred in December 2021. This means that this has been an ongoing process for nearly four (4) years. This breach happened due to a prepaid cell phone provider the company used to run its phone plans.

The prepaid provider is TracFone and the retailer ran the phone plans under the operation of Walmart Family Mobile. This provider failed to protect sensitive information of customers and put them at risks. This means that private information was accessible to the public. It was claimed that the service provider could have prevented this breach if it invested in more efficient cybersecurity measures.

The following is crucial to note; if you were affected by the leak of data, you should provide proof the purchase to receive any financial payment. In this case, those who will submit their claims should provide a receipt, an invoice or bank statement that would indicate that they suffered out-of-pocket losses due to the service provider, TracFone breach.

Data Breach Settlement

It is important to note that Walmart is not the only company using TracFone as a service provider, but companies like Straight Talk, Simple Mobile, and Net10 Wireless, also make use of it. Therefore, this data breach settlement will benefit all the affected customers from these companies. Also, Total wireless is amongst the five companies that use TraceFone and who experience a data leak.

In addition, it is important to note that the prepaid service provider did not admit taking responsibility for the leak, but it agreed for the payout of the settlement claims. This generally occur because companies do not want to proceed with the litigation but rather settle for class actions. The reason for this is because the whole legal process can be a costly process and companies would lose a lot of money.

The deadline for the claims is today, August 7. Walmart customers are encouraged to use this time wisely. If they did not yet submit their claim, they still have time today. If they let this opportunity pass you by, unfortunately you will not receive a payout, even if your data was leaked. It is high encourage that individuals do not submit a fraudulent claim, indicating their information were leaked if it was not. This could result in major consequences and harm eligible class members.

Expected Payout

Customers who are eligible to claim for this lawsuit, can receive a payout for both ordinary and extraordinary expenses. When it comes to ordinary losses class action members could receive up to $3,250 per person. These ordinary losses could include aspects like:

  • Bank fees,
  • Credit-related costs, and
  • Communication charges related to the data leak.
On the other hand, extraordinary losses pay out up to $50,000 for losses that are related to the following:
  • Identity theft,
  • Fraud or,
  • Lost business opportunity costs.

This makes a total payout of $53,250 that affected customers can claim for. However, it is crucial to keep in mind that compensation goes further than just financial payouts. These class action members can also manage to receive up to three years if free credit monitoring services through this data breach settlement.
